1. Service Description

VanillaSky ("we," "us," or "our") operates vanillasky.ai, a chat-first AI video builder. You describe a video to an AI agent and it composes scenes from real stock footage, royalty-free music, AI-generated text overlays, animated backgrounds, and visual effects — all rendered in your browser. You refine the result by chatting.

2. Acceptance of Terms

By accessing or using VanillaSky, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. We may update these terms at any time, and your continued use of the Service after changes constitutes acceptance of the revised terms.

3. Account Terms

VanillaSky currently does not require user accounts or authentication. You may use the Service anonymously. If we introduce accounts in the future, additional terms will apply and will be communicated to you at that time.

4. Intellectual Property

Your output videos: You retain ownership of the videos you create using VanillaSky, subject to the licenses of the underlying assets used in your video (see Section 5 below).

Our platform: The VanillaSky platform, including its design, code, user interface, and branding, is our intellectual property and may not be copied, modified, or distributed without our express written permission.

AI-generated content: Text overlays and scene compositions are generated by AI via Anthropic's Claude API. We do not guarantee that AI-generated content is unique, original, or free from third-party intellectual property claims. You are responsible for reviewing and ensuring that your final video does not infringe on the rights of others.

5. Third-Party Content

VanillaSky integrates third-party content to enhance your videos:

• Stock footage and images: Sourced from Pexels. All Pexels content is subject to the Pexels License, which permits free use for personal and commercial purposes with certain restrictions.
• Music tracks: Curated royalty-free soundtracks are included for use within videos created on VanillaSky. These tracks are licensed for video use through our platform.

You are responsible for complying with the applicable third-party licenses when using and distributing your videos.

6. Acceptable Use

You agree not to use VanillaSky to:

• Create deepfakes, non-consensual intimate imagery, or content that impersonates real individuals without their consent.
• Produce content that is illegal, defamatory, threatening, harassing, or promotes violence or discrimination.
• Resell, redistribute, or sublicense individual stock clips, images, or music tracks obtained through the platform as standalone assets.
• Attempt to reverse-engineer, decompile, or disassemble the Service.
• Use automated systems to scrape, harvest, or extract data from the Service.
• Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to suspend or terminate access for any user who violates these terms.

7. DMCA and Copyright Takedown

We respect the intellectual property rights of others. If you believe that content on VanillaSky infringes your copyright, please send a written notice to [email protected] including:

• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material that is claimed to be infringing.
• Your contact information (name, address, phone number, email).
• A statement that you have a good faith belief that the disputed use is not authorized.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
• Your physical or electronic signature.

8. Free Tier

VanillaSky currently offers its core features at no cost, including the chat-first video builder, stock footage, music, custom animations, and unlimited MP4 exports — no watermark. We reserve the right to introduce paid tiers, modify the free tier, or change feature availability at any time with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by applicable law, VanillaSky and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, nor do we make any warranty as to the quality, accuracy, or reliability of any content generated through the Service.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any modifications constitutes your acceptance of the revised terms.
